Mediation & Collaborative Family Law on AM650

Shelina Sayani and Sonia Kainth of Henderson Heinrichs LLP spoke for an hour last week with Stirling Faux of AM650 Radio about collaborative family law, mediation, arbitration, and parenting coordination in Vancouver family law.  Alternative Dispute Resolution is a cornerstone of Henderson Heinrichs LLP’s approach and our top family law mediators gave some insight.

Shelina Sayani and Sonia Kainth are both trained and certified collaborative family law practitioners.  They discussed the benefits of this process and how a collaborative is often a better fit for individuals who are dealing with a family law issue as the process allows the for the parties to engage helping professionals, such as divorce coaches and child specialists, to help them wade through the emotions and issues ultimately coming to a resolution that the parties have themselves created and can stick to.  The collaborative process is often more expedient and less expensive than litigation.

The Collaborative Family Law Practitioners of Henderson Heinrichs also discussed the concept of Parenting Coordination at length.  Shelina Sayani is a certified parenting coordinator and explained that in circumstances where the parties have an agreement or a court order, it is often less confrontational and less expensive to hire a parenting coordinator to assist parties in resolving low level disputes over issues related to children.  Shelina Sayani and Sonia Kainth pointed out that the Family Law Act in British Columbia mandates that alternative dispute resolution methods be prioritized and parenting coordinators serve a valuable purpose in lessening the court’s case load.

Shelina Sayani and Sonia Kainth also talked about the importance of mediation in the family law process.  Both in Vancouver and in Toronto, mediation plays a pivotal role in bringing parties together on contentious issues and helping those parties avoid court.  They pointed out that it is usually better to reach an agreement and have some say in the outcome of a family law or divorce case than to take a chance with a court making a decision that neither party is happy with.
